PS is there some confusion here? The one of the thin dark girl is probably on clips4sale; she may now have her own site, actually; the one deleted then put up on savefile, of a more generous lady, may not be on clips4sale at all.....

Don't worry Deal, it's not a problem. At this point, all we have is a statement from one forum member that the clip is copyrighted material, and he's offered us no proof that this is the case. Until we can ascertain that it is, I see no reason for you to need to remove it. Your generosity and time is certainly appreciated either way!

I've added one more clip from Kelsey that occured on July 18th at 1:28 AM. Decent vid, although slightly dark, but otherwise good. Slight nose scrunch prior to the single sneeze. Clip can be found in my project located here.

I don't think these have been posted yet. It's a female sneeze from a television show outtake reel. The sneezer is the young lady lying in the hospital bed. And she gets out one sneeze around the 21~22 second mark.

You see a clip on Youtube that you like, you should save it then and there. Would you write a document in Word, go take a nap without saving it and assume it would still be there when you woke up?

The lesson of the last few pages on here is that people should download any vid on youtube that they like then and there. If a clip is subsequently taken down, it is probably for a good reason and people (however well intentioned) who subsequently post it on here could be putting the forum at some risk.

I suspect the moderators would feel "better safe than sorry" is the way to go on such matters

I know you chaps absolutely hate it when I say something isn't illegal when you are already feeling guilty about it, but I'm just a fool to myself:

Breach of copyright, as the name suggests, involves copying something. The forum is not copying anything. Perhaps it ought to be. All that is being done is referencing or pointing to something which may or may not be a copy; like publishing times of tv programmes.

Moreover, breach of copyright is a civil tort, not a crime [unless possibly huge commercial deception is involved, like pirate videos]. So the FBI and RCMP really can't do much about it when they surveille us. In practical terms, only those commercially selling vids are ever likely to take any action against infringers, and they're not going to do anything beyond a polite request to cease publishing the copy, which we have already seen people are quite ready to do.

Yes, copying stuff on to savefile is theoretically a tort; but in reality who is ever going to worry about it?

I won't ask any questions; but I expect someone is going to tell me that a person appearing in a video has some sort of ability to control their image.....go on. then.

No, count, it's not that at all. It's the fact that we (the staff) don't want to alienate members of our community who create the clips and run the clipstores for the rest of you. We're trying to sort out if the clip is, in fact someone's property (i.e. they made it and have it up for sale), and if it is, we won't allow it to be posted. If it has been offered by this person for free before (the current assumption), then we have no problem making it available. What we do have a problem with is people copying and redistributing material they've bought from members of the site - we find it disrespectful to those making the materials available, and we won't condone it.

It'd be as if someone who bought one of the Ultimate videos or whatever other video has been sold here in the past, made a bunch of copies, and offered them up, or copied it digitally and made it available for download. That's pretty much all the issue is right now.

The sneezes are real in those 3 youtube videos. They are from Cantstopsneezing who told us about them in her observations post. I don't have them, like everyone else so far i missed them but caught a pic on one of the favorites of our members on youtube. So hopefully we didn't miss the boat and maybe Cantstopsneezing will repost them or someone else might have them all.

Added two more clips from Kelsey this morning. Would have done it last night but as noted earlier in this thread, Savefile was acting up yesterday.

In any event, the first is a single from K that occurs on July 14th at 11:16 PM. Good video and audio. She even announces it and tells her friend that it's because of the candles she's lighting.

The second is a double from K, again good vid and audio. It also includes a couple of sniffles and a nose scrunch. This occured on July 14th at 11:27 PM. Guess those candles are still getting to her.

I don't know or want to go into the legality of these matters, but my gut feeling is this - if the clips are currently for sale on one of the clipstores it is disrespectful and counterproductive to share these clips for free. Why would anyone bother to make new material if they thought people would just rip it off and share it?

I think things are more hazy with regard to people who made material in the past and have long vanished into cyber space. I personally feel the Ultimate videos were priced out of a lot of people's reach (and are no longer available legitimately for purchase) and so would not feel (personally) upset if they had been posted on to You Tube.

There are moral issues in posting copyright material, sure, but there are moral questions in filming people secretly and using it as part of a video you sell for $500 a copy.

And before I wander any further of topic, I shall shut up...

what clips are these? reading her post in obs, she had saved them and reposted them? or were they of herself? the way she phrased it makes me think i may know which clips she means, if anyone can show me a picture, or the clip, i may have the other. that is, if it was from the past.

Great work in saving this clip Greek!.....I wonder if she took the clips down by accident? Posting them on YouTube under the name "cantstopsneezing" sort of makes me think she knew what she was doing, right?....I mean if she had just posted them on a channel with all types of random clips, then removed them due to getting a little "wierded out" by repsonses left to the clips is understandable, but posting them under a channel named "cantstopsneezing" and the three sneezing vids being the only material posted on the channel makes me think they were intentionally posted for our enjoyment, which leaves me bemused as to why the clips were taken down.....ohhh just my .02 cents talking out loud, sorry

Anyway if anyone has seen these videos with internet explorer he could save these.tools-internet options-general-settings-vie files.temporary internet files appear and there are some files there that start with get video...and after the http adress...logically none remembers the youtube adresses of these three clips but probably you could remember the time and the date that you say these.if you found these copy this file from temporary internet files and paste somewhere in your pc.after you click in this file which saved in your pc right click-properties and in the name of file in the end write .flv.you click ok and the clip can play with flv programm.I think the most here know this way but i ll make last tries finding the other two clips of her(unfortunately i have seen these with mozilla)

I've uploaded two more clips from Kelsey. The first from July 18th at 1:23 PM, which has two sneezes and excellant video and audio. The second clip is from July 15th. Sadly, no video and so-so audio. She was out of the room for some of them, however it was an incredible run with some 7 sneezes during the original three minute clip. I cut it down considerably, dropping much of the dead air.

Kelsey's friend Rachael, who sneezed in an earlier clip setup her own site located here. I'm posting two clips from Rachael's archives of Kelsey sneezing. The first one, entitled July 15th 2:54 AM Pt. 2 contains the third and fourth sneeze by Kelsey in the big vid of K's run of 7 that I posted yesterday. Still can't really see Kelsey, but you get a bit of a glimpse of her.

The second vid entitled July 15th 2:57 AM is actually the 8th, 9th, and 10th sneeze by K from her huge fit. Kelsey however had already turned off her feed by that point since she was packing up to go home. It's all audio, no pictures of K although you can see Rachael.

Next, a third clip from K's archives from July 15th at 1:49 PM containing two from K. Good audio and video in this one.

Finally, I'm in the process of uploading the FLV file from K's big fit of 7 for anyone who wants the entire thing with all the dead air. One note, at the very end of this you can see K's face as she prepares for the 8th sneeze in the 2:57 AM vid mentioned above. Since this is a large clip though, I won't be placing it on the premium service and taking up that space. So fair warning, once it's gone from lack of downloads, it's gone.
